America ABA LLC • Florida, United States Effective date: February 16, 2026 Last updated: November 1, 2026
1. Who we are and what these terms cover
These Terms & Conditions (“Terms”) govern use of the public website at americaaba.com and the America ABA family portal (together, the “Digital Services”), operated by America ABA LLC (“America ABA,” “we,” “us,” or “our”), a Florida limited liability company.
The Digital Services provide information about ABA therapy and related support, allow families and referring providers to contact us, and give invited and authorized family members access to information and communications that our team shares through the family portal. Features may differ by account and may change.
These Terms are not a treatment consent, patient financial agreement, insurance assignment, HIPAA authorization, Notice of Privacy Practices, or agreement to receive marketing communications. Those documents, when applicable, govern their own subjects. These Terms do not override them or reduce rights provided by law.
2. Agreement and eligibility
Please read these Terms before using the Digital Services. If you do not agree, do not use optional website or portal features and contact us about another way to communicate. Where affirmative acceptance is requested or required, it must be obtained separately; these Terms do not replace legally required consent.
Family portal accounts are available by invitation only and are intended for adults age 18 or older who have been approved by America ABA and have authority to access the relevant account and information. The Digital Services are not intended for children to create accounts or submit information independently. Parents, legal guardians, and other authorized representatives may submit information and request access on behalf of a minor or another individual when legally permitted.
An invitation or account creation does not independently establish legal authority to access another individual's information. America ABA may verify identity, parental authority, guardianship, custody, or other legal authority before granting access.
If you are a parent, guardian, or other representative, provide accurate information about your authority and tell us promptly if it changes.
A referring provider must have authority or another lawful basis to share the information submitted. Do not submit information about another person without appropriate permission or legal authority.
3. Inquiries, eligibility, and starting services
Submitting a form, requesting a call, receiving an acknowledgment, or receiving a portal invitation does not by itself enroll anyone in treatment, establish a clinical relationship, reserve a place, or guarantee an assessment, diagnosis, service location, start date, or specific clinician.
Care depends on individual needs, clinical review, service-area coverage, staffing, required permissions, insurance authorization where applicable, and completion of applicable intake and service agreements. School-based services may require school permission and coordination.
Website statements about availability, waitlists, insurance, or services describe information available when posted and may change. Please confirm what is available for your family directly with our team.
4. Educational content and clinical guidance
Public articles, videos, FAQs, examples, and other general resources are educational. They are not an individual evaluation, diagnosis, treatment plan, or substitute for advice from a qualified professional familiar with the person receiving care. No particular result is guaranteed.
Family portal information may reflect individualized care-team communications within an existing clinical relationship. Nothing in these Terms disclaims the professional duties that apply to that relationship. Follow your individual care plan and ask your care team about information you do not understand.
5. Emergencies and response times
The website, inquiry forms, email, text messages, and family portal are not emergency services and should not be used for urgent medical or safety needs. They are not monitored continuously, and delivery or a read indicator does not guarantee immediate review or response.
Call 911 for an immediate emergency. In the United States, call or text 988 for suicide or crisis support. For non-emergency questions about care, contact the care team through the channels provided to you.
6. Family portal access and account security
Portal access is limited to invited, verified, and authorized users and the individuals and information made available to them. An inquiry or invitation alone does not automatically authorize access to another individual's records. Do not share sign-in credentials, use another person's account, or let an unauthorized person use your access. Each authorized representative should use their own approved access.
Use reasonable precautions, including securing your email and devices, signing out of shared devices, and protecting downloaded files and screenshots. Notify us promptly if you suspect unauthorized access or if your authority, contact information, or guardianship status changes.
Parental and Representative Access
Where a portal user requests access on behalf of a minor or another individual, America ABA may verify parental, guardianship, custody, or other legal authority before granting or continuing access. Access to records and information may be limited by applicable law, court orders, custody arrangements, confidentiality requirements, or the rights of the individual receiving services.
Parents and legal representatives should notify America ABA promptly of material changes to custody, guardianship, parental authority, or court orders affecting access. America ABA may request updated documentation when reasonably necessary to confirm authority or resolve conflicting requests. We may restrict or suspend access while a legitimate authority or access dispute is being reviewed, consistent with applicable law.
We may verify identity and authority, restrict access, or suspend an account to protect information, investigate misuse, comply with law, or reflect a change in authorization. Portal access is separate from the legal right to request records and from any clinical decision about continuing or ending care.
7. Information and materials you provide
Provide accurate information and correct material errors promptly. Submit only information relevant to your inquiry or authorized use. Do not send medical documents or sensitive information through a general contact form or ordinary email when an approved secure channel is available.
You retain any rights you have in materials you submit. You give America ABA permission to receive, store, reproduce, and share those materials only as reasonably necessary to respond to you, provide and administer authorized services, operate and secure the Digital Services, and comply with applicable obligations, subject to privacy requirements.
Submitting information does not grant permission to use it in public advertising, testimonials, or other unrelated purposes. Any additional permission required for those uses must be obtained separately.
8. Privacy and health information
Our website Privacy Policy, available at https://americaaba.com/privacy, explains the public website practices within its stated scope. Health information, treatment records, and family portal information may also be subject to separate privacy notices and applicable healthcare privacy requirements. These Terms do not expand the scope of the website Privacy Policy or replace a Notice of Privacy Practices.
Our website may use cookies, analytics technologies, advertising pixels, security tools, and similar technologies, including Google Analytics and Meta Pixel, to support website functionality, understand website usage, evaluate advertising performance, improve our services, and protect our systems.
The specific technologies used, information collected, purposes of collection, and applicable choices should be described in our Privacy Policy. We will apply appropriate restrictions to prevent impermissible disclosure of protected health information or other sensitive information to analytics, advertising, or other third-party platforms. The presence of an analytics or advertising tool does not authorize disclosure of protected health information.
Where required, we will obtain appropriate permissions and implement applicable privacy and security safeguards before using these technologies.
We may use third-party service providers to support website hosting, communications, authentication, payment processing, analytics, and other functions. Their handling of information is subject to applicable contractual, privacy, and security obligations. Our use of third-party providers does not eliminate America ABA's responsibilities under applicable law.
We may need to verify identity or representative authority before responding to privacy or records requests. Closing an account or withdrawing a communication preference does not automatically delete records that must be retained for clinical, legal, billing, security, or other lawful purposes.
No online system can guarantee complete security. Contact [email protected] with privacy or account-security concerns, but do not include sensitive medical details in an initial general inquiry.
9. Calls, email, text messages, and electronic notices
When you submit a contact request, we may respond using the contact details you provide, consistent with your request, choices, and applicable law. General email and text messaging can carry privacy risks and should not be used for emergencies or detailed clinical information.
Service-Related Text Messages
Where you separately opt in or otherwise provide legally sufficient authorization, America ABA may send service-related messages concerning inquiries, appointments, scheduling, administrative updates, care coordination, and other communications related to services you have requested or receive.
Marketing and Educational Text Messages
America ABA may separately offer marketing, promotional, and educational text messages, including information about company updates, resources, events, and services. These communications will be sent only where the required consent has been obtained.
Marketing text consent is optional and is not a condition of requesting or receiving healthcare services. Consent to service-related communications does not automatically constitute consent to marketing communications, and vice versa.
Message Terms and Opt-Out
For text programs where applicable, message frequency varies; message and data rates may apply. Reply STOP to opt out or HELP for help, or contact us through another reasonable method to withdraw consent. Requests to stop messages will be handled in accordance with applicable law and carrier requirements.
Consent may be withdrawn through any reasonable method permitted by applicable law, including a reply message, where supported, or another available communication channel. Withdrawal of consent for one type of communication does not necessarily withdraw consent for other separately authorized communications.
Withdrawing text consent does not cancel care or prevent communications permitted or required through other channels.
Agreeing to these Terms or submitting a form is not, by itself, consent to marketing messages or automated calls. Any legally required consent for automated calls, texts, or other regulated communications must be obtained separately.
Account and service notices may be provided electronically where permitted. Any legally required consent to electronic signatures or delivery must be obtained separately.
10. Insurance, estimates, and payments
A website insurance logo, benefits inquiry, or portal estimate does not guarantee network participation for a particular plan, coverage, authorization, reimbursement, or the amount a family will owe. Confirm benefits and financial responsibility with the insurer and our billing team.
Insurance verification is based on information available from the insurer at the time of verification. Final coverage and payment determinations are made by the applicable insurance carrier based on the member's benefits, eligibility, authorizations, medical necessity determinations, claims processing, and applicable plan provisions. America ABA cannot guarantee that an insurer will approve or reimburse any particular service or claim.
An insurer's out-of-pocket maximum or accumulated spending is not itself a balance owed to America ABA. Estimates can change as benefits, services, claims, and insurer decisions are verified.
These Terms do not establish a portal subscription, authorize a charge, create a payment plan, or impose a cancellation fee. Treatment charges, approved payment plans, collection authorization, cancellations, and refunds are governed by the applicable separate financial agreements, required notices, and law.
If a payment feature is available, use the approved secure payment flow and review its terms. Any automatic or recurring payment arrangement requires separate authorization through the applicable payment process. The payment authorization should identify the payment method, applicable amount or calculation method, payment schedule, and cancellation or revocation process. Do not send payment-card or bank-account details through ordinary messages.
11. Acceptable use
Do not use the Digital Services to break the law, impersonate someone, provide fraudulent information, harass others, send malware or spam, interfere with access, bypass security or access controls, or obtain information you are not authorized to view.
Do not collect or disclose another family's information, attempt to access unrelated records, or use automated tools to extract private information. Do not use website or portal content to train commercial AI systems or redistribute protected materials without permission. These restrictions do not prohibit lawful accessibility tools, legally protected activity, or uses permitted by law.
12. Ownership and permitted use of our content
America ABA and its licensors retain their rights in the Digital Services, branding, design, software, and original content. You may access public resources and materials shared with you for personal, noncommercial purposes connected to learning about or coordinating care, subject to any specific resource permissions.
Do not misrepresent our content as your own, remove ownership notices, sell it, or imply our endorsement. Third-party names and marks belong to their owners. These Terms do not transfer ownership of patient records, submitted materials, or rights that applicable law gives you.
13. Third-party services and links
The Digital Services may link to external resources or rely on third-party providers for functions such as hosting, sign-in, authentication, communications, electronic signatures, analytics, advertising, or secure payments. External sites and services may have their own terms and privacy notices. A link does not by itself establish a partnership or endorsement.
Certain Digital Services features may be provided through third-party technology providers acting on our behalf. These providers may process information as necessary to deliver their contracted services and are subject to applicable contractual, privacy, and security obligations. Where required, America ABA will enter into appropriate agreements with providers that handle protected health information.
We do not control independent third-party websites or guarantee their content or availability. This provision does not eliminate any responsibility America ABA has under applicable law for its own selection, use, or oversight of service providers.
14. Availability, accessibility, corrections, and alternative access
The Digital Services may be interrupted by maintenance, technical issues, network problems, or circumstances outside our reasonable control. We may correct errors, update content, or change features. Please report inaccurate information rather than relying on an apparent error.
Keep copies of materials you need where you are authorized to do so, and contact us if you cannot access an important item. If a digital feature is unavailable or inaccessible to you, call 786-471-3091 to discuss another way to communicate or obtain information.
Accessibility
America ABA is committed to making its Digital Services accessible to individuals with disabilities. We work to improve website and portal usability and accessibility. If you experience difficulty accessing content, using a feature, or obtaining information due to a disability, please contact us at [email protected] or 786-471-3091. We will work with you to identify an appropriate alternative method of access or communication.
We do not promise uninterrupted access or a particular website response time. Changes to digital access do not remove rights to records, accessibility, nondiscrimination, continuity of care, or other protections required by law.
15. Warranties and responsibility
To the extent permitted by law, general public website content and nonclinical digital functionality are provided on an “as available” basis without a promise that they will be error-free or fit every user's needs. This does not disclaim individualized clinical duties or express obligations in a separate agreement.
To the extent permitted by law, America ABA is not responsible for indirect or consequential losses arising solely from use of general website content or interruption of nonclinical digital features. This limited exclusion does not apply where prohibited by law or excuse fraud, intentional misconduct, gross negligence, professional negligence, unlawful disclosure of information, or other liability that cannot lawfully be excluded.
Nothing in these Terms waives nonwaivable consumer, healthcare, privacy, disability, or other statutory rights. These Terms do not require arbitration or a class-action waiver.
16. Ending use and retaining records
You may stop using the Digital Services at any time and contact us about account access or communication preferences. We may restrict or end access for unauthorized use, security risks, loss of representative authority, legal requirements, or a material violation of these Terms.
Restricting digital access does not itself terminate a treatment relationship. Clinical discharge, transfer, and continuity-of-care requirements are handled separately. Appropriate record-retention and privacy obligations continue after digital access ends.
17. Updates to these Terms
We may revise these Terms prospectively and identify the applicable effective date and last updated date. We will provide notice of material changes through the website, portal, or another appropriate channel and obtain renewed acceptance where required by law.
Where portal users are asked to accept an updated version, America ABA may maintain a record of the version accepted and the date and time of acceptance for administrative and compliance purposes.
Changes do not retroactively remove accrued rights or replace any separate consent required for treatment, payments, electronic delivery, or marketing. If you disagree with an update, stop using optional digital features and contact us about alternatives.
18. Governing law and other provisions
These Terms are governed by Florida law, without regard to conflict-of-law rules, and applicable United States federal law. Subject to any mandatory legal rights or jurisdiction rules, disputes concerning these Terms may be brought in a court with proper jurisdiction in Florida.
If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. Not enforcing a provision on one occasion does not waive the right to enforce it later.
These Terms concern the Digital Services only. Separate signed treatment and financial agreements and legally required privacy notices govern their respective subjects; mandatory law controls in any conflict.
